Information We Collect

Once you provide personal information, home listing information or credit card information, you are no longer anonymous to us and therefore consent to the transfer and storage of that information on our servers located in the United States.

We may collect and store information, including name, address, telephone number, email address, property listing details and photographic images, and when necessary, credit card information. We may also collect the following additional information:

• Transactional information based on your activities on the site
• Other information from your interaction with our site, services, content and advertising, including computer and connection information, statistics on page views, traffic to and from sites, ad data, IP address and standard web log information
• Other supplemental information from third parties (for example, if you incur a debt to Private Sale Partners, we will generally conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law; or if the information you provide cannot be verified, we may ask you to send us additional information, such as your driver's license, credit card statement, or a recent utility bill or other information confirming your address, or to answer additional questions online to help verify your information).

We may collect this information when you perform one or more of the following activities (either on our site or through our Customer Sales Center):

• Register to become a member as a Seller
• Purchase a home listing plan
• Make a purchase at our Store
• Create a home listing with details, description, photos and a home visit scheduler
• Return an item or exchange an item
• Entering a contest or sweepstakes
• Participate in a marketing survey, promotion or event
• Register as a Buyer to receive email alerts of home listings
• Complete a pre-screening registration to schedule a home visit

We also gather information about how visitors navigate through our site by using clickstream data from 'cookies' or other online tools. A 'cookie' is a small data file that is stored by your web browser on your computer. Most cookies are 'session cookies', meaning that they are automatically deleted from your hard drive at the end of a session. Cookies enable you to place an order more easily on our web site by recognizing you when you return to our web site by storing, among other things, your user name and password, saving you time from having to re-enter that information each time you visit our web site. You are always free to decline our cookies if your browser permits, although doing so may interfere with your use of some of our site or services. We will maintain the data that you provide us, along with a record of your purchases or scheduled home visits in a secure database and use your information only as permitted by law. To best serve you, we may combine this information with data that is publicly available and data that we receive from other reliable sources whose policies meet the Direct Marketing Associations privacy standards. If you request specific products or services, we will transfer your listing contact information as required by vendors, companies, affiliates, and partners, unless you specify otherwise.

Credit card information collected provides our members with the convenience of purchasing our products and services online. Credit card information is defined as any information that appears on a page where a credit card number can be submitted. All credit card information is protected by YourPay(sm) encryption technology. Once submitted, your credit card information is stored behind our firewall to ensure that it remains secure. Your credit card information will not be distributed unless we have your permission to do so or unless required by law.

We don't sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. We may use or provide affiliates or partners with aggregate information from the information obtained from all users and the aggregate information can not be used to contact you. This Privacy Policy does not apply to any affiliates or partners use of such information and we are not responsible for the privacy policy or content of our affiliates or partner's websites.

Our primary purpose in collecting your personal, listing or credit card information is to provide you with a safe, effective and efficient experience with our web site and Customer Sales Center. You agree that we may use your information to:

• Provide the services and customer support you request
• Notify, via email or telephone, member sellers of home visit appointments and buyer contact information consisting of name, phone number, employer name and phone number and email address
• Resolve disputes, collect fees, and troubleshoot problems
• Prevent potentially prohibited or illegal activities, and enforce our User Agreement
• Process e-commerce transactions
• Customize, measure, and improve our services and the Sites' content and advertising
• Inform you about targeted marketing, service updates, promotional offers, products or other services, based on your communication preferences
• Compare information for accuracy, and verify, as needed with third parties
• Update Privacy Policy and Terms of Use

Because email is used to provide certain notifications and services, registered Sellers and Buyers with access to a computer must consent to receive e-mail from Private Sale Partners. All Sellers without access to a computer will receive certain notifications and services via telephone and therefore must consent to receive calls from the Customer Sales Center. You hereby consent to any such communication or phone calls even if your phone number is on any DO NOT CALL list.

We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone's rights, property, or safety.

We may also share your personal information with:

• Members of our corporate family to help detect and prevent potentially illegal acts and provide joint content and services (for example, registration, transactions and customer support). Our corporate affiliates and partners will send marketing communications only to users who request these services.
• Service providers under contract who help with our business operations (such as fraud investigations and bill collection).
• Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
• Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose information relevant to the investigation, such as name, city, state, zip code, telephone number, email address, User ID history, IP address, fraud complaints, listing history and scheduled home visits.
• Other business entities, should we plan to merge with or be acquired by that business entity. Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information will be used contrary to this policy, you will receive prior notice.

Without limiting the above, in an effort to respect your privacy, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

Advertisers, affiliates and partners of Private Sale Partners are expected to also safeguard the privacy of our registered members with their own privacy and information collection policies and terms of use. Private Sale Partners is not responsible for the actions or policies of such third parties. Further, these third parties may also use cookies or other technology to assist with your identification or retrieve information about you. Private Sale Partners does not control, nor is responsible for the use of this technology or the resulting information and is not responsible for any actions or policies of such third parties.

Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your Private Sale Partners password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify Private Sale Partners and change your password.

Information Security

Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

Accessing, Reviewing and Changing Personal Information

Registered members can see, review and change personal and home listing information or credit card information by signing on to our web site. We will not manually modify your personal information. You must promptly update your personal information if it changes or is inaccurate. Once you make a public home listing, the information contained therein is not the responsibility of Private Sale Partners. Upon your request, we will close your membership and or delete your home listing information from view as soon as reasonably possible. We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, or take any other actions otherwise permitted by law.

Opt Out Choices

If you prefer not to receive email communications sent directly from our advertisers, partners or other non-affiliates, you will given an opportunity to decline before you might provide the information we might share with them. We may, from time to time, permit our advertisers, partners or non-affiliates to email you about products, services, special offers or content we mutually believe might interest you. If you decline or 'opt out' of this opportunity to receive such information, we will not share the personally identifiable information you provide with them for such purposes, though we may from time to time send you information on their behalf.

Additionally, we may provide personal information collected to our real estate partners in order to enhance the opportunity of locating potential buyers for a specific home or property listing. If you decline at the time you provide such information, we will not share your personal information you provide with our real estate partner's local agents and brokers.

Our web site is not intended for use by children under the age of 13, and we do not knowingly collect or solicit personally identifiable information from or about children under the age of 13.

We may amend this Privacy Policy at any time by posting the amended terms on this site. All amended terms automatically take effect 30 days after they are initially posted on the web site. Please check this page periodically for changes. Your continued use of our site following the posting of changes to these terms will mean you accept those changes. Information collected prior to the time of any change is posted will be used in accordance to the rules and laws applicable at the time the information was collected.

Governance

This policy, the use of this Web site, and the Terms of Service are governed by Delaware law. Any claim related to the Site or this policy shall be brought in a federal or state court in Delaware, within one year after the claim arises. You agree no such claim may be brought as a class action. Users of Private Sale Partners consent to the jurisdiction and venue of such court as the most convenient and appropriate for the resolution of disputes concerning this policy. Private Sale Partners is controlled, operated and administered entirely within the United States. If you are located outside the United States, please note the information you provide to us will be transferred to the United States. You hereby consent to this transfer.

In the event case of any conflict between the terms of this policy and the terms of any electronic or machine readable privacy policy (for example, a P3P electronic privacy policy), the terms of this written policy shall control.
